1. Prices and Payment
All prices are net including VAT, expressed in euros, excluding delivery and assembly costs. Payment is always made in advance by bank transfer or online via iDEAL, Bancontact, Visa or Mastercard.
2. Delivery and Cancellation
The customer is informed in writing, by telephone and/or by e-mail about the status of ordered or to be delivered goods. E-Products Europe BV reserves the right to refuse delivery based on order size and/or geographical location.
Cancellation: The customer has the right to cancel the order free of charge as long as it has not yet been shipped. Once the product is on its way, cancellation is no longer possible. The customer then has the statutory withdrawal right of 14 days after receipt.
Delivery:
- Small packages are shipped via a parcel delivery service.
- Large packages are delivered by E-Products Europe BV with our own delivery van or trailer. Unloading of goods takes place exclusively on the ground floor. The customer helps the driver to place the product together in the right place.
- In case of self-collection or transport by the customer themselves or by third parties on behalf of the customer, transport is at the customer's own risk.
The delivered goods remain the property of E-Products Europe BV at all times until they are fully paid for.
The stated delivery times are indicative delivery times. By signing the delivery note, you agree to the good quality of the delivered goods. If you do not agree with the quality, you can note this on the delivery note, after which we will process this as soon as possible.
3. Invoice
Within 10 working days, the customer receives the invoice in writing or by e-mail.
4. Warranty
E-Products Europe BV guarantees the quality of the products it delivers for 2 years, from the delivery date to the end user (proof of purchase with date required), for manufacturing, material or construction defects.
Excluded are: defects caused by unprofessional assembly or installation, normal wear and tear, defects caused by incorrect or negligent maintenance, defects caused by incorrect use or vandalism, repairs carried out by third parties, and modifications made to the product by the customer.
5. Damage or Missing Parts
The customer has up to 48 hours after delivery to report any damage or missing parts to E-Products Europe BV. E-Products Europe BV will provide the necessary replacement parts and deliver them to the customer at its own expense.
E-Products Europe BV is only liable for damage to the goods if it delivers them to the customer itself. Transport by the customer themselves or by third parties on behalf of the customer is at the customer's own risk. All goods are thoroughly inspected by E-Products Europe BV before each transport.
E-Products Europe BV cannot be held liable if injury occurs due to incorrect use of the purchased goods. Shipping costs associated with returning a product are at the customer's expense.
6. Return Policy
You have the right to inform us within 14 days of receipt that you are withdrawing from your purchase, without giving a reason. The period of 14 calendar days allows you to assess and inspect the purchased item as in a store. During this time, you must handle the item with the necessary care. You may only unpack the item to the extent necessary to exercise your right of inspection.
If you exercise your right of withdrawal, the product must be returned to us with all supplied accessories and – if reasonably possible – in its original condition and packaging. If the product is damaged or the packaging is more damaged than necessary to assess the product, we can charge you for this depreciation. Therefore, handle the product with care and ensure it is well packaged when returning.
7. Returns
You have the right to cancel your order up to 14 days after receipt without giving a reason. After cancellation, you have another 14 days to return your product. You will then be credited the full order amount, including shipping costs. This will be done no later than 14 days after withdrawal.
Only the costs for the return shipment from you to our address are at your own expense. Return address: BV E-Products Europe, Hannaerden 1A, 9280 Lebbeke.
Please pack the product well (preferably in cardboard). After we have received the product back, we will refund your money within 5 working days. Send us your IBAN number via e-mail: [email protected].
8. Invoice Terms
Invoices are payable on the stated due date to the bank account of E-Products Europe BV, as stated on the invoice. If the invoice is not paid on the due date, a conventional and default interest is due by operation of law and without notice at the interest rate determined in Article 5 of the Law of 02/08/2002 on combating late payment.
Any late payment gives E-Products Europe BV the right to charge a flat-rate compensation of 15% of the invoice amount, with a minimum of €40 and a maximum of €2,500, to cover administrative costs.
All costs resulting from enforcing payment through amicable and legal means, including bailiff and lawyer costs (legal costs), will be charged to the customer. Non-payment of one invoice on the due date automatically makes all outstanding invoices payable, regardless of their due date.
9. Retention of Title
All goods remain the property of E-Products Europe BV and are claimable until the invoice is fully paid by the buyer. In case of dispute, only the courts of Ghent are competent.
10. Order
The customer acknowledges having read and accepted the general terms and conditions when placing the order. E-Products Europe BV reserves the right to refuse an order for any reason. In that case, the full purchase amount will be refunded to the customer.
11. European ODR Platform for Complaints
It can always happen that something does not go entirely as planned. We recommend that you first make complaints known to us by emailing [email protected].
Since February 15, 2016, it is also possible for consumers in the EU to submit complaints via the European Commission's ODR platform: http://ec.europa.eu/odr.
12. Characteristics of Wood and Maintenance
Wood is a natural product: it lives and moves. Wood is not plastic or metal and therefore has different properties. Moreover, every tree and every plank is different. This ensures that you receive a unique product.
Wood protects against heat and sound, is strong yet elastic, and easy to work with. Those who know wood take into account the following properties. These do not constitute a reason to reject the wood or to file a complaint.
Knots and grain: Wood is pure nature. Knots, growth rings and color differences are part of it. Depending on the species and age, they can vary greatly. Firmly grown knots are not considered inferior quality in the garden furniture industry.
Green spots: Green spots can occur due to the reaction between resin and impregnating agent. Upon exposure to sunlight, this green tint will gradually disappear.
Stains and blue algae (mold): This can occur when products are stored in too humid conditions. Mold formation can often simply be removed with a dry cloth. Impregnated wood is actually more resistant to mold.
Discoloration: Wood discolors under the influence of sunlight. Just after impregnation, it may have a green tint; after that, it gets its natural color, to gradually turn gray over time.
Warping of wood: Wood can warp as a result of its natural action. This is normal and cannot be completely avoided. The longer the plank, the greater the chance of warping.
Cracks and splits: Wood expands and contracts under the influence of relative humidity. This can cause cracks and splits. This is a normal phenomenon with a natural, organic material.
Resin formation: Sometimes resin can emerge from the wood. This is a natural property. Resin can be removed by first letting it dry and then carefully cutting it away with a sharp knife.
Treatment and Maintenance of Wood
Most wood products offered are impregnated. Each product sheet states whether the product is impregnated or not. If a product is impregnated, this means that the wood has been treated against rot, mold and insects.
We recommend treating all purchased garden furniture, even when impregnated, with wood oil to increase durability.
These wooden garden furniture (with the exception of beer tables and beer benches) can remain outside all year round. Over time, the wood will discolor under the influence of weather and UV light and take on a gray tint. Due to the natural action of wood, play can occur in the construction; we recommend tightening your garden furniture again after the winter period.
Beer tables and beer benches are not impregnated but double lacquered. If you want to maintain the original condition, we recommend not leaving them outside permanently. If you do, they will weather over time.
